Welcome to Suppleyes. These Terms and Conditions ("Terms") govern your use of our website and services and apply to all purchases made through www.suppleyes.com.au (the “Site”). By accessing or using our Site, you agree to comply with and be bound by these Terms.
These Terms and Conditions (“Terms”) apply to the use of the Suppleyes website and to goods and services purchased from CORNADO PTY LTD (ABN 36 164 719 108) trading as SUPPLEYES (“Suppleyes”, “we”, “us” or “our”), including purchases made through our website, by email, telephone or through an approved credit account.
By placing an order with Suppleyes, you agree to these Terms. If you are purchasing on behalf of a business or organisation, you confirm that you are authorised to place orders on its behalf.
These Terms and Conditions (“Terms”) apply to the use of the Suppleyes website and to goods and services purchased from CORNADO PTY LTD (ABN 36 164 719 108) trading as SUPPLEYES (“Suppleyes”, “we”, “us” or “our”), including purchases made through our website, by email, telephone or through an approved credit account.

1. Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (“ACL”) where the ACL applies.
Nothing in these Terms is intended to exclude, restrict or modify any guarantee, right, remedy or other protection available under the Competition and Consumer Act 2010 (Cth), the Australian Consumer Law or any other applicable legislation where it would be unlawful to do so.

Suppleyes makes reasonable efforts to ensure that product descriptions, specifications, images and other information provided on our website are accurate.
Product images are provided for illustrative purposes. Actual product appearance, packaging, colour or presentation may vary from images displayed. Manufacturers and suppliers may alter product specifications, packaging or presentation from time to time.
Customers are responsible for checking product descriptions, specifications, dimensions, pack quantities and other relevant product information before ordering.
Product availability is subject to stock and supplier availability.
Products may be identified on our website as either “Stocked Item” or “Order In Item”. Different return conditions apply to these products as set out in these Terms.

3. Prices and GST
All prices are in Australian dollars and include GST unless otherwise stated.
Suppleyes may change prices from time to time.
Where a price changes after an order has been submitted but before the order has been accepted or supplied, Suppleyes will advise the customer of any material increase. The customer may choose whether to proceed with the affected order.
Any applicable delivery, freight or other charges will be disclosed or agreed before the order is completed where practicable.
Customers with separately agreed contract, group, account or special pricing will be charged in accordance with those agreed arrangements.
All prices are in Australian dollars and include GST unless otherwise stated.
Suppleyes may change prices from time to time.
Where a price changes after an order has been submitted but before the order has been accepted or supplied, Suppleyes will advise the customer of any material increase. The customer may choose whether to proceed with the affected order.
Any applicable delivery, freight or other charges will be disclosed or agreed before the order is completed where practicable.

4. Orders and Acceptance
All orders are subject to acceptance by Suppleyes.
An automated order confirmation or acknowledgement does not necessarily constitute acceptance of an order.
Suppleyes may decline or cancel an order where a product is unavailable, information or pricing is incorrect, we reasonably suspect fraudulent or unauthorised activity, applicable credit facilities are unavailable, or there is another reasonable basis for us not to supply the order.
If payment has already been received for an order that Suppleyes subsequently cancels, we will refund the amount paid for goods that will not be supplied.
Once an Order In Item, special-order product, custom product or specially procured quantity has been ordered from our supplier or entered into production, the order generally cannot be cancelled or changed unless Suppleyes agrees otherwise.
All orders are subject to acceptance by Suppleyes.

Unless the customer has an approved Suppleyes credit account, payment is required in accordance with the payment arrangements offered or agreed at the time of purchase.
Customers with an approved credit account must pay invoices in accordance with their approved trading terms.
Amounts owing to Suppleyes must be paid without deduction or set-off except where required or permitted by law.
Suppleyes may apply amounts it owes a customer against amounts that customer owes Suppleyes where permitted by law.
Unless the customer has an approved Suppleyes credit account, payment is required in accordance with the payment arrangements offered or agreed at the time of purchase.
Customers with an approved credit account must pay invoices in accordance with their approved trading terms.

Suppleyes may apply amounts it owes a customer against amounts that customer owes Suppleyes where permitted by law.
6. Credit Accounts
Credit facilities are available only to customers approved by Suppleyes.
Approval of a credit account does not require Suppleyes to provide credit for any particular order or amount. Suppleyes may establish and review credit limits and may suspend, reduce or withdraw credit facilities in accordance with the applicable credit account terms.
Customers with an approved credit account are also subject to the terms accepted as part of their Suppleyes Credit Application and Trading Terms Agreement.
Where an approved Credit Application or Trading Terms Agreement contains additional or more specific provisions relating to credit terms, overdue accounts, guarantees or debt recovery, those provisions apply to that credit facility.
Credit facilities are available only to customers approved by Suppleyes.
Approval of a credit account does not require Suppleyes to provide credit for any particular order or amount. Suppleyes may establish and review credit limits and may suspend, reduce or withdraw credit facilities in accordance with the applicable credit account terms.
Customers with an approved credit account are also subject to the terms accepted as part of their Suppleyes Credit Application and Trading Terms Agreement.
Where an approved Credit Application or Trading Terms Agreement contains additional or more specific provisions relating to credit terms, overdue accounts, guarantees or debt recovery, those provisions apply to that credit facility.
7. Shipping and Delivery
Suppleyes delivers to eligible locations using our own delivery arrangements and/or third-party freight providers.
Applicable freight charges and available delivery options are determined according to the order, delivery location and any agreed customer-specific freight arrangements.
Any dispatch or delivery time communicated by Suppleyes is an estimate unless expressly agreed otherwise.
While Suppleyes makes reasonable efforts to dispatch and deliver orders promptly, delays may occur because of stock availability, suppliers, freight providers or circumstances outside our reasonable control.
Risk in goods passes to the customer upon delivery.
Where the customer has authorised delivery without obtaining a signature, including an Authority to Leave arrangement, goods will be treated as delivered when left at the authorised delivery location.
The customer is responsible for providing accurate delivery information and ensuring that the delivery location is reasonably accessible and suitable for receiving the order.
Additional freight or redelivery charges resulting from incorrect delivery information, failed delivery attempts or circumstances within the customer's control may be charged to the customer.
Suppleyes delivers to eligible locations using our own delivery arrangements and/or third-party freight providers.

Any rights Suppleyes may have in relation to security interests or the Personal Property Securities Act 2009 (Cth) are subject to applicable law and any separately agreed trading or security terms.
Title to goods supplied by Suppleyes remains with Suppleyes until all amounts owing in respect of those goods have been paid in full.
Risk in the goods passes to the customer upon delivery notwithstanding that title may remain with Suppleyes.
Any rights Suppleyes may have in relation to security interests or the Personal Property Securities Act 2009 (Cth) are subject to applicable law and any separately agreed trading or security terms.
9. Returns – Stocked Items
Products identified as “Stocked Item” on the Suppleyes website are eligible for return where the customer changes their mind or incorrectly orders a product, provided the customer contacts Suppleyes within 7 days of delivery to request the return.
To be eligible for return, products must be unused, unopened, in saleable condition and in their complete original packaging with all components, labels, accessories and inserts intact.
Return freight and any associated freight costs are the responsibility of the customer unless the return is due to an error by Suppleyes or the goods are faulty, damaged or otherwise subject to rights or remedies under applicable law.
Products must not be returned without prior approval from Suppleyes.
Where an order is for an unusually large quantity of a Stocked Item that Suppleyes has purchased or procured specifically to fulfil that customer's order, Suppleyes may advise the customer before accepting the order that the quantity will be treated as an Order In Item and will not be eligible for change-of-mind return.
Nothing in this section limits any rights or remedies available under the Australian Consumer Law.
Products identified as “Stocked Item” on the Suppleyes website are eligible for return where the customer changes their mind or incorrectly orders a product, provided the customer contacts Suppleyes within 7 days of delivery to request the return.

Products identified as “Order In Item” on the Suppleyes website are products that are not normally held in stock by Suppleyes and are ordered or procured specifically to fulfil a customer's order.
Order In Items are not eligible for return due to change of mind, incorrect ordering or because the goods are no longer required.
Customers should check product descriptions, specifications, dimensions, colours, quantities and other relevant product information carefully before ordering an Order In Item.
Custom-made, personalised, configured or manufactured-to-order products are also treated as Order In Items unless otherwise advised by Suppleyes.
Nothing in this section excludes, restricts or modifies any rights or remedies available under the Australian Consumer Law, including where goods are faulty, damaged, not as described or otherwise fail to meet applicable statutory guarantees.
Products identified as “Order In Item” on the Suppleyes website are products that are not normally held in stock by Suppleyes and are ordered or procured specifically to fulfil a customer's order.
Order In Items are not eligible for return due to change of mind, incorrect ordering or because the goods are no longer required.
Customers should check product descriptions, specifications, dimensions, colours, quantities and other relevant product information carefully before ordering an Order In Item.

11. Faulty, Damaged or Incorrect Goods
Customers should notify Suppleyes as soon as reasonably practicable if goods arrive damaged, are faulty or are different from the goods ordered.
Suppleyes may request photographs, product information or other reasonable evidence to assist us in assessing the issue.
Depending on the circumstances and the customer's rights under applicable law, the appropriate remedy may include repair, replacement, refund or another remedy.
Where appropriate, goods may be subject to manufacturer or supplier warranty assessment. This does not exclude, restrict or modify any rights or remedies available under the Australian Consumer Law.
Where Suppleyes has supplied an incorrect product, Suppleyes will arrange or cover the reasonable cost of returning the incorrectly supplied goods.
Customers should notify Suppleyes as soon as reasonably practicable if goods arrive damaged, are faulty or are different from the goods ordered.
Suppleyes may request photographs, product information or other reasonable evidence to assist us in assessing the issue.
Depending on the circumstances and the customer's rights under applicable law, the appropriate remedy may include repair, replacement, refund or another remedy.

Customers are responsible for maintaining the confidentiality of their website account login details and for taking reasonable steps to prevent unauthorised access.
Customers should notify Suppleyes promptly if they become aware of unauthorised use of their account.
Suppleyes may suspend or restrict an online account where reasonably necessary for security, suspected misuse, unpaid accounts or other legitimate business reasons.
Customers are responsible for maintaining the confidentiality of their website account login details and for taking reasonable steps to prevent unauthorised access.
Customers should notify Suppleyes promptly if they become aware of unauthorised use of their account.
Suppleyes may suspend or restrict an online account where reasonably necessary for security, suspected misuse, unpaid accounts or other legitimate business reasons.
13. Intellectual Property
Unless otherwise stated, content on the Suppleyes website, including Suppleyes branding, text, graphics, photographs and original product content, is owned by or licensed to Suppleyes.
Content must not be reproduced, distributed or commercially used without permission except as permitted by law.

Suppleyes collects, uses, stores and discloses personal information in accordance with applicable privacy laws and our Privacy Policy.
Information provided in connection with an application for commercial credit may also be used for credit assessment, account administration, credit management and debt recovery in accordance with the consent provided in the relevant credit application and applicable law.
